These Terms of Service (“Terms”) govern your access to and use of TalentXIQ, a digital self-assessment tool operated by TheKsmart LLC (“we”, “us”, “our”). By using the Service, you agree to these Terms.

1. Nature of the Service

TalentXIQ provides educational self-assessment tools focused on career development, work style, and professional strengths. The Service is not a clinical psychological evaluation, medical service, or diagnostic instrument.

2. Eligibility

You must be at least 16 years old to use the Service. By using TalentXIQ, you confirm that you meet this requirement.

3. Payments and Subscriptions

Some parts of the Service may require a one-time payment or a recurring subscription. Payments are processed securely by Stripe. By completing a purchase, you authorize TheKsmart LLC to charge your selected payment method.

Subscription charges recur automatically at the stated interval unless canceled before the renewal date. You can manage or cancel subscriptions via the account or via the instructions provided in your purchase confirmation.

4. Refunds

Because our products are digital and provide immediate access to reports and content, all sales are generally non-refundable once access is granted.

If you believe you have been charged in error, contact us at support@theksmart.com and we will review your case.

5. Acceptable Use

You agree not to:

• Use the Service for illegal or unauthorized purposes
• Copy, resell, or redistribute test content or reports
• Attempt to reverse engineer or disrupt the platform
• Misrepresent the Service as a clinical or diagnostic tool

6. Intellectual Property

All content within the Service—including test items, scoring logic, reports, design, and branding—is the intellectual property of TheKsmart LLC and is protected by applicable laws. You receive a personal, non-transferable license to use the Service for your own educational purposes.

7. No Guarantees

We do not guarantee that using TalentXIQ will result in employment, promotion, or specific outcomes. The Service is intended as a tool for self-reflection and preparation only.

8. Limitation of Liability

To the maximum extent permitted by law, TheKsmart LLC is not liable for any indirect, incidental, or consequential damages arising from your use of the Service. Your sole remedy for dissatisfaction is to stop using the Service.

9. Changes to the Service

We may modify or discontinue parts of the Service at any time, with or without notice, provided that active paid subscriptions will retain access for the duration of the billing period.

10. Changes to These Terms

We may update these Terms occasionally. The “Last updated” date indicates the latest revision. Continued use of the Service after changes means you accept the new Terms.

11. Billing, Introductory Fee & Subscription Renewal

When you purchase the “Full Report Access” offer, you will be charged an introductory, one-time fee of $1 USD. By completing this purchase, you authorize TalentXIQ (operated by TheKsmart LLC) to automatically enroll you in a monthly subscription of $9.99 USD, which begins 30 days after the introductory purchase, unless you cancel beforehand. The monthly subscription provides continued access to advanced analytics, career insights, premium content, and downloadable reports. You may cancel the subscription at any time before the next billing cycle. If not canceled, your payment method will be automatically charged each month. No refunds are provided for partial billing periods.

12. Acceptance of Terms Before Purchase

By clicking “Unlock Full Report” and completing the checkout process, you agree to these Terms of Service and acknowledge that your purchase includes a recurring payment plan, which you may cancel at any time after the first month.
